DRAFT. This is a draft of the terms of use for parents. It is not yet final. Details in [SQUARE BRACKETS] are still to be filled in by the owner, and a qualified adviser must approve this text before it goes live.

Terms of use for parents

Key information

1. About these terms

1.1 These terms are between you and [LEGAL NAME] ("we", "us"). They cover your use of 11Prep Detectives at [DOMAIN] (the "Service"). Our privacy notice [LINK] and cookie statement [LINK] are separate documents.

1.2 When you pay, Paddle.com Market Limited (or the Paddle entity shown at checkout) is the seller of record and its Buyer Terms apply to the purchase. We provide the Service and the content. [VERIFY entity in the Paddle sandbox.]

1.3 Nothing in these terms limits your statutory rights as a consumer.

2. Who can use it

2.1 You must be 18 or over and a parent or legal guardian of any child whose name you add. You confirm this when you register.

2.2 Children use the Service only through your account. You are responsible for supervising your child and for keeping your password and PIN private.

3. Your account

3.1 Give accurate details. You can add up to six child profiles using a first name or nickname only. Please do not enter surnames, schools or addresses.

3.2 You must confirm your email address. Until you do, you can only sign in, resend the link, download or delete your data.

3.3 You can download your data or delete your account at any time in the parent area. Deleting the account cancels any live subscription immediately; paid access then ends and the refund rules in clause 8 still apply.

3.4 If an account is unused for 12 months we delete it after a warning email, as the privacy notice explains. Accounts with a live paid subscription are not deleted automatically.

4. The Service and its content

4.1 11Prep Detectives is a story-based 11+ practice game with monthly "seasons" of cases, practice rounds and weekly tests in maths, English, verbal reasoning and non-verbal reasoning.

4.2 Free access: [Season 1] and any other seasons we mark free. Paid access: every season that has been released while your subscription is active.

4.3 Seasons are released over time. A season shown as "planned" is not yet available, its date and contents may change, and it is not part of what you buy until it is released. [REVIEWER: confirm this is a fair description; check the pricing page does not imply a fixed number of seasons.]

4.4 If your subscription ends: everything released up to the end of your paid period stays open for revision; seasons released after that do not. Your child's progress is kept (subject to clause 3.4).

5. Price, payment and renewal

5.1 Price and billing period are shown at checkout. Prices include tax where tax applies; Paddle calculates and collects it.

5.2 Your subscription renews automatically at the end of each billing period and the card or payment method you gave is charged until you cancel. We will remind you by email [7 to 14] days before an annual renewal [and before any renewal that follows a change of price]. [Paddle may also send its own notices: VERIFY in sandbox. From spring 2027 the DMCC Act will require reminder and end-of-contract notices on a durable medium such as email.]

5.3 Price changes: we will give at least [30] days' notice by email before a new price applies to your next renewal. You can cancel before it applies.

5.4 Failed payments: Paddle retries the payment. We keep your access for [5] days after the renewal date while it retries. If payment still fails, access to paid seasons stops as in clause 4.4.

5.5 Access codes: a code gives free access for a set number of days. It cannot be combined with a live paid subscription and has no cash value.

6. Cancelling

6.1 Cancel at any time online: Parent area > Manage billing (opens Paddle's billing page). [VERIFY the portal offers cancellation in the sandbox.] You can also email [SUPPORT EMAIL] and we will cancel for you [within 1 working day].

6.2 Cancellation stops the next renewal. You keep access until the end of the period you have paid for. We do not refund part-used months or years except under clauses 7 and 8 or where the law requires.

7. Your legal right to cancel within 14 days

7.1 Under the Consumer Contracts Regulations 2013 you have 14 days from the day the contract is made to cancel a digital-content purchase without giving a reason.

7.2 Immediate access. We make paid content available as soon as payment is confirmed. At checkout you are asked to agree that we may give you access straight away and to acknowledge that, once access begins, you would normally lose the statutory right to cancel. [PADDLE-EXPECTED WAIVER WORDING, from Paddle's Buyer Terms: "...unless during that 14-day period, you started downloading, streaming, using or benefiting from the Product, when during your Transaction you agreed for us to make the Product available for your use before the end of that 14-day period." Use Paddle's exact checkout text; do not paraphrase it differently here. VERIFY it appears in the sandbox checkout.]

7.3 Whatever you agree at checkout, clause 8 still gives you a full refund within 14 days. The waiver therefore costs you nothing and exists only because Paddle's checkout requires it. [OWNER DECISION: see Option B in the drafting notes if you prefer to rely on the waiver instead.]

7.4 To use your right, use the refund route in clause 8.3. A model cancellation form is not required but you may use the wording in clause 8.4.

8. Refund policy (default proposal)

8.1 14-day money-back guarantee. Ask within 14 days of (a) your first payment, or (b) an annual renewal payment, and we will refund 100% of that payment, no questions asked. Monthly renewals after the first month are not refundable under this clause.

8.2 A full refund ends access. When a full refund is processed, your paid access ends at once and the account returns to free access. [This matches the app: a full approved refund or chargeback sets the plan to expired immediately. A partial refund does not change access.]

8.3 How to ask: email [SUPPORT EMAIL] from the address on your account with the subject "Refund", or use the refund option in Paddle's billing page where shown. We approve valid requests within [2] working days. Paddle pays the refund to your original payment method, normally within [14] days of approval.

8.4 Model wording: "I want to cancel my 11Prep Detectives subscription bought on [date] under email [address] and receive a refund."

8.5 After 14 days: no refund of the current period, except [OWNER DISCRETION: where a fault we cannot fix prevents you using the paid content; we will refund the unused part pro rata]. Statutory remedies for faulty digital content (Consumer Rights Act 2015) are unaffected.

8.6 Chargebacks: if you dispute a payment with your bank instead of contacting us, paid access ends while it is investigated. Please contact us first.

8.7 Paddle's own refund policy says refunds are otherwise discretionary and statutory withdrawal rights apply to consumers in the UK; where our promise in this clause is more generous, ours applies and we will instruct Paddle to refund. [VERIFY Paddle onboarding accepts a seller-defined refund promise.]

9. Acceptable use

You agree not to: share your login or sell or pass on access; copy, scrape or republish our questions, stories or images except for your own child's private study; attempt to access other people's accounts or our systems, or test our security without written permission; use bots or automated tools; enter another person's personal data, or a child's surname, school or address; or use the Service for anything unlawful. We may suspend or close an account that breaks these rules, after a warning where reasonable. If we close an account without your fault, we refund the unused paid period.

10. Content and intellectual property

All questions, stories, artwork, code and design are owned by [LEGAL NAME] or our licensors. You get a personal, non-transferable licence to use them for your own child's study. Practice questions are original and are not official past papers and are not affiliated with, or endorsed by, GL Assessment, any school, council or exam provider. [REVIEWER: check no third-party material or trademarks are used.]

11. Accuracy of content

We check our questions and answer keys carefully, but errors can occur, and test formats, timings and school arrangements change every year. Our content is a guide, not an official specification. Always check the current format, dates, registration and admissions rules with each school and local authority. Tell us about any error at [SUPPORT EMAIL]; we will correct it as soon as we reasonably can.

12. Availability and changes

12.1 We aim to keep the Service available but cannot promise uninterrupted access. We may carry out maintenance, and outages can happen. [TARGET: none promised.]

12.2 We may change or improve the Service. If we make a change that materially reduces what a paying customer gets, we will tell you and you may cancel and receive a pro-rata refund of the unused period.

12.3 The Service needs a modern browser and an internet connection.

13. Your data

How we use personal data is explained in the privacy notice. Paddle is an independent controller for payment data. We never see card numbers.

14. No guarantee of results

11Prep Detectives helps children practise. We do not guarantee any score, pass, qualification or place at any school. Selection depends on your child, other candidates, each school's rules, distance or catchment, and factors outside our control. Scores in the Service are practice indicators only and do not predict an official result.

15. Our responsibility

15.1 Nothing limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else the law does not allow us to limit.

15.2 The digital content must be of satisfactory quality, fit for its purpose and as described. If it is not, you have the remedies in the Consumer Rights Act 2015 (repair or replacement, price reduction, refund).

15.3 Subject to 15.1 and 15.2 we are responsible only for foreseeable loss caused by our breach or negligence. We are not liable for business losses (the Service is for personal use only) or for losses you could have avoided by following our reasonable advice. [SOLICITOR TO SET ANY CAP; a cap on consumer liability must be reasonable.]

16. Ending the contract

You can stop at any time (clause 6). We may end the contract if you materially breach these terms, if we stop offering the Service (we will give at least [30] days' notice and refund unused prepaid time), or where the law requires.

17. Changes to these terms

We may update these terms for good reason (law, service changes). We will email you [30] days before a change that affects you takes effect. If you do not agree, you can cancel before then.

18. Complaints, law and disputes

18.1 Contact [SUPPORT EMAIL] first; we aim to reply within [5] working days.

18.2 These terms are governed by the law of [England and Wales] [SOLICITOR: add Scotland and Northern Ireland wording for consumers there]. You may bring a claim in the courts of the part of the UK where you live.

18.3 [ADR: state whether we use an approved ADR provider. SOLICITOR TO CONFIRM duty.]
